Terms of Use

Vendo Mis Juguetes (the "Platform") is a listing site for families in Mérida, Mexico. It provides a simple and safe place for parents and children to list children's items for sale. The Platform is built and operated by Sjenkie B.V., a private limited company (besloten vennootschap) registered in the Netherlands.

By using the Platform, you agree to these Terms of Use. If you do not agree, please do not use it.

• The Platform is a listing and visibility site for children's items (like toys, books, games, costumes, sports items, etc.).
• It allows users to display listings and receive inquiries from potential buyers.
• The Platform does not process payments, arrange deliveries, or act as an intermediary in any transaction.
• Any communication, agreement, or sale happens directly between buyer and seller, outside the Platform.
• Basic listing is free. A Pro subscription plan is available starting at MX$120/month, billed through Lemon Squeezy. Applicable taxes (including IVA) are collected and remitted by Lemon Squeezy as Merchant of Record.

• The Platform is built and operated by Sjenkie B.V. (KvK number available on request), a private limited company registered in the Netherlands. Sjenkie B.V. is responsible for the design, development, content, and day-to-day operation of the Platform.
• The Platform may be modified, suspended, or discontinued at any time. Where possible, advance notice will be provided.

The Platform offers a paid Pro plan in addition to the free tier.

• The Pro plan is available at MX$120/month, MX$300/quarter, or MX$1,080/year (before tax - applicable IVA is added at checkout by Lemon Squeezy).
• Subscriptions renew automatically at the end of each billing period until cancelled.
• You may cancel your subscription at any time from your account settings. Your Pro benefits remain active until the end of the current billing period.
• If you are not satisfied with the Pro plan, you may request a full refund within 14 days of your first payment - no questions asked.
• No refunds are provided after the 14-day money-back guarantee period.

Why we use Lemon Squeezy

• All subscription payments are processed by Lemon Squeezy, LLC (lemonsqueezy.com), a US-based company that acts as our Merchant of Record (MoR).
• As Merchant of Record, Lemon Squeezy is the legal seller of the subscription on our behalf. This means Lemon Squeezy - not Sjenkie B.V. - handles billing, payment processing, tax calculation, invoicing, and refund execution.
• We chose Lemon Squeezy because it simplifies international tax compliance (including Mexican IVA), provides PCI-DSS compliant payment security, and allows us to focus on building the Platform rather than managing payment infrastructure.
• When you subscribe, your payment card details are collected and stored by Lemon Squeezy directly. Sjenkie B.V. never receives, sees, or stores your full card number. We only receive a subscription status confirmation.
• Prices are stated in Mexican Pesos (MXN). Applicable taxes, including IVA, are calculated, collected, and remitted by Lemon Squeezy.

• Parents or legal guardians must create and manage all accounts.
• Children may participate only under adult supervision.
• Parents decide what information to share and when to reply to inquiries.

• Only children's items (like toys, books, games, costumes, sports items, etc.) may be listed - no other products, services, or digital items.
• Users must ensure all listings are accurate, lawful, and family-appropriate.
• Buyers fill out a short inquiry form; sellers receive the buyer's details by email.
• Sellers decide whether to contact the buyer and complete any sale privately.
• The Platform may remove listings or close accounts at any time without warning if users post unrelated or inappropriate content or violate these Terms.

• Only the colonia is shown publicly - never exact addresses or phone numbers.
• Contact information is shared only if a parent chooses to respond to an inquiry.
• Users are responsible for meeting in public, safe locations and taking standard precautions.

• Listings must be suitable for all ages and appropriate for a family audience.
• Prohibited content includes: non-children's items, services, illegal or dangerous goods, adult material, discriminatory, or offensive content.
• The Platform may remove any listing or image that violates these rules or Mexican law.

• All listings and photos submitted to the Platform are reviewed before being made visible to the public.
• The Platform may approve, reject, or remove any listing or image at any time, with or without notice.
• Review times may vary, but most listings are published usually within 48 hours if they follow these Terms.
• Users may not demand publication, appeal moderation decisions, or expect specific turnaround times.

By creating an account or using the Platform, you acknowledge and agree that:

• You are fully responsible for your use of the Platform and for any listings, messages, or actions you take.
• The Platform has no obligation to monitor, verify, or moderate user behavior or listings.
• You assume all risks related to communications, meetups, or exchanges arising from your use of the Platform.
• The Platform cannot be held responsible, in any circumstance, for the actions, omissions, or conduct of users.
• You agree not to hold the Platform liable and not to pursue any legal claims arising from your use of the Platform.

The Platform is provided "as is", without any warranties of any kind.

The Platform is not responsible for:

• the accuracy or completeness of listings or communications,
• the safety, legality, or quality of any items,
• or any loss, damage, dispute, or injury resulting from use, exchanges, or sales.

The Platform cannot be held liable, financially or legally, for any claim arising from use of the Platform.

Users agree to use the Platform entirely at their own risk and to indemnify (protect) the Platform from any claims, damages, or legal demands resulting from their use of the site.

The Platform reserves the right to discontinue, modify, suspend, or permanently shut down the service at any time, with or without prior notice. In the event of permanent service termination, an announcement will be posted on the website. The Platform may edit, suspend, or remove listings, or close user accounts at any time. The Platform is provided "AS-IS" and "AS AVAILABLE" without any warranties or guarantees of continuous operation. Users acknowledge that there is no guarantee the service will remain available indefinitely.

These Terms are governed by Dutch law (the law of the Netherlands), reflecting the operator's place of incorporation. Disputes will be submitted to the competent court in the Netherlands, without prejudice to any mandatory consumer rights you may have under applicable local law.

• All design, text, and visuals created for the Platform remain property of the Platform.
• Users retain ownership of their own photos and descriptions but grant the Platform permission to display them.
